By accessing or using Bobcat Toolbox Pro ("the Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by ProfessionUp, LLC, a California limited liability company doing business as Bobcat Medical ("Company," "we," "us," or "our"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Bobcat Toolbox Pro is a software-as-a-service (SaaS) readability scoring platform that analyzes text documents and produces readability metrics including Flesch-Kincaid Grade Level, SMOG Index, Gunning Fog Index, and Coleman-Liau Index scores, along with compliance assessments against AHRQ, AMA, and Joint Commission plain-language standards.
THE SERVICE IS PROVIDED FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. READABILITY SCORES PRODUCED BY THE SERVICE ARE DIAGNOSTIC TOOLS BASED ON MATHEMATICAL FORMULAS AND DO NOT CONSTITUTE A GUARANTEE OF PATIENT COMPREHENSION, REGULATORY COMPLIANCE, OR ACCREDITATION APPROVAL.
Specifically:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL THE COMPANY'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree NOT to submit documents containing Protected Health Information (PHI) as defined by the Health Insurance Portability and Accountability Act (HIPAA) through free or Pro plan accounts. PHI includes patient names, dates of birth, medical record numbers, health plan beneficiary numbers, account numbers, Social Security numbers, geographic data smaller than state, dates related to an individual, and any other information that could identify a specific patient.
The Service is designed for use with template documents and de-identified content. Before submitting any document for analysis, you must remove all patient-identifying information.
Team and Enterprise plan customers may request a Business Associate Agreement (BAA) by emailing compliance@bobcattoolbox.com. A BAA is required before submitting any content that may constitute PHI. The Company does not offer BAAs for free or Pro plan customers.
The Service does not store the text content of submitted documents. Only computed scores and metadata (document name, date, grade level, compliance status) are retained in your account history. Document text is processed in memory and discarded immediately after scoring.

The Service is offered in Free, Pro ($49/month), and Team ($149/month) tiers. Pricing is subject to change with 30 days' notice to current subscribers.
Paid plans include a 14-day free trial. No credit card is required to start a trial. At the end of the trial period, you will be asked to provide payment information to continue on a paid plan. If payment is not provided, your account automatically returns to the free tier.
Subscriptions are billed monthly or annually in advance. All payments are processed by Stripe, Inc. By providing payment information, you authorize the Company to charge your payment method on a recurring basis until you cancel.
If a payment fails, Stripe will retry the charge after 3, 5, and 7 days. You will receive email notification of each failed attempt. If all retry attempts fail, your account will be downgraded to the free tier. You remain responsible for any outstanding balance.
If you believe you have been charged in error, contact billing@bobcattoolbox.com within 30 days of the charge. We will investigate and respond within 2 business days. We prefer to resolve billing disputes directly before you contact your card issuer, as this results in faster resolution for you.
7-Day Satisfaction Guarantee: If you are not satisfied with your first paid subscription, you may request a full refund within 7 days of your first charge by emailing billing@bobcattoolbox.com. No questions asked.
After 7 Days: We do not offer refunds for partial subscription months after the 7-day window. If you cancel, you retain access through the end of your current billing period.
Annual Plans: Annual subscriptions may be refunded on a prorated basis within 30 days of the annual renewal date.
Exceptions: We will issue refunds outside these windows in cases of billing error or duplicate charges. Contact billing@bobcattoolbox.com.
The Service, including its software, design, text, graphics, and readability algorithms as implemented, is owned by ProfessionUp, LLC and protected by United States and international intellectual property laws. You retain all rights to documents you submit for analysis. You grant the Company a limited license to process submitted text for the purpose of delivering readability scores.
Either party may terminate this agreement at any time. You may cancel your subscription through the dashboard or by emailing support@bobcattoolbox.com. The Company may suspend or terminate accounts that violate these Terms, with or without notice. Upon termination, your right to use the Service ceases. Account data is retained for 30 days post-termination, after which it is deleted.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in California.
The Company reserves the right to modify these Terms at any time. Material changes will be communicated via email to registered users at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
